Terms of Service

1. Scope
These terms govern the use of mailampel.com, in particular the paid domain monitoring. They address both businesses and consumers; provisions applying to only one group are marked accordingly. Deviating terms of the customer do not apply.
2. Free services
The one-off domain check, the email report and the ongoing monitoring of the first domain of an account are free of charge. There is no legal claim to free services; they may be changed or discontinued at any time. Results are generated automatically from public DNS data and provided without warranty.
3. Paid service: domain monitoring
The monitoring checks the mail security settings of the registered domains (SPF, DKIM, DMARC, MTA-STS, TLS-RPT, DNSSEC, MX and related records) once a day. If the state deteriorates compared to the last check, a warning email is sent; regular status reports (daily, weekly or monthly) can be configured in addition. Management happens in the dashboard; teams share domains, and team domains are paid for by the team owner.
4. Prices
Every domain beyond the free first one costs €5 per month or — with yearly billing — €50 per year. All prices are final; as a small business under § 6 (1) 27 of the Austrian VAT Act, no VAT is charged. Volume pricing can be agreed individually from around 10 domains.
5. Conclusion of contract, billing, quantity adjustment
The contract for paid monitoring is concluded when the customer completes the purchase in the dashboard. Payment is processed by Stripe; payment details are entered directly with Stripe and never reach our servers. The subscription covers the number of paid domains: when a domain is added or ended, the quantity of the running subscription is adjusted and billed pro rata. Invoices and receipts are issued by Stripe, delivered by email and also available in the dashboard.
6. Term and cancellation
The subscription renews automatically for the respective billing period (month or year). It can be cancelled at any time effective at the end of the current period — via the Stripe customer portal (dashboard → billing) or by ending all paid monitors. Periods already paid remain usable until they end; there is no refund for the remainder of a period. Statutory rights — in particular the right of withdrawal under section 7 — remain unaffected.
7. Right of withdrawal for consumers
Consumers within the meaning of the Austrian Consumer Protection Act may withdraw from the contract within 14 days of its conclusion without giving reasons — informally, for example by email to kontakt@mailampel.com. Sending the notice in time is sufficient.
Monitoring starts immediately after purchase, i.e. before the withdrawal period expires. If a consumer withdraws after the service has begun at their request, a proportionate amount for the service provided until withdrawal is payable; the rest is refunded.
8. Customer obligations
Customers may only monitor domains they are responsible for or authorised to monitor. The email address of the account must be able to receive mail — warnings and reports are delivered there only.
9. Availability, warranty, liability
The service is operated with great care, but uninterrupted availability is not guaranteed. Results are based on public DNS responses at the time of checking and may deviate due to circumstances beyond our control; they replace neither your own checks nor individual advice. Liability for slight negligence is excluded, except for personal injury. Towards businesses, liability is additionally capped at the fees paid for the service in the preceding twelve months. Mandatory statutory consumer rights remain unaffected.
10. Changes to these terms
Changes are announced by email to the account address or clearly on the next sign-in. If the customer continues to use the paid service after the announced effective date, the changed terms apply; otherwise the customer may cancel effective at the end of the period.
11. Governing law and jurisdiction
Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. For businesses, the place of jurisdiction is St. Pölten; for consumers, the statutory places of jurisdiction apply, and mandatory protective provisions of an EU consumer's state of residence remain unaffected.
12. Dispute resolution
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board. Please address complaints directly to kontakt@mailampel.com.
